Terms of Service

1. Agreement

By creating an account or using Vityy (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. These Terms form a binding contract between you and Vityy, operated from Lakewood, Colorado.

2. Eligibility

You must be at least 13 years old to use Vityy. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.

3. Your account

You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly if you believe your account has been accessed without authorization.

4. Acceptable use

Do not use Vityy to send spam or unsolicited bulk mail, harass, impersonate, upload unlawful or infringing content, probe our infrastructure, or attempt to bypass quotas or entitlements. You are responsible for the guest lists you upload and must have a legitimate reason to contact those recipients.

5. Your content

You retain ownership of event content, guest lists, and photos you upload ("Your Content"). You grant us a limited license to host, process, transmit, and display Your Content solely to operate the Service on your behalf. We may remove content that violates these Terms.

6. AI features

The AI copilot sends your prompts to our model provider to generate drafts. Output is generated and may contain inaccuracies; review it before use. You are responsible for anything you send on the basis of AI-generated drafts.

7. Plans, billing, refunds

Paid plans (monthly, yearly) and per-event unlocks are billed through Stripe. Prices are shown at checkout. Subscriptions renew automatically until cancelled; cancel any time from Settings → Billing.

Refunds: subscription fees are refundable on a prorated basis for unused events within 7 days of the most recent charge. Per-event unlocks are non-refundable once invitations for the event have been sent.

8. Termination

You can close your account at any time. We may suspend or terminate accounts that violate these Terms or that pose risk to the Service. On termination we will delete your data in line with our Privacy Policy.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that email delivery will always succeed.

10. Limitation of liability

To the maximum extent permitted by law, Vityy is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim, or USD $50, whichever is greater.

11. Governing law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Colorado for any dispute arising out of or relating to the Service.

12. Changes

We may update these Terms from time to time. Material changes will be posted here with a new "last updated" date. Continued use after a change constitutes acceptance.
